How the Deposit Protection Service Works to Ensure Fairness in Rental Agreements
The Deposit Protection Service (DPS) is one of the government-approved deposit protection schemes in the UK, designed to safeguard tenants' deposits and resolve disputes between landlords and tenants fairly. Under the Housing Act 2004, landlords who rent out properties on an assured shorthold tenancy (AST) basis must protect their tenants' deposits in a government-approved scheme within 30 days of receiving the funds. The DPS offers both custodial and insured deposit protection options, providing landlords with flexibility in how they secure their tenants' deposits.
In the custodial scheme, landlords transfer the deposit to the DPS, which holds it securely throughout the tenancy. At the end of the tenancy, both parties can agree on how the deposit should be distributed. If there is a dispute, the DPS offers a free alternative dispute resolution (ADR) service to help resolve disagreements between landlords and tenants. Alternatively, in the insured scheme, landlords retain possession of the deposit but must pay a fee to the DPS to protect it. This scheme offers the same dispute resolution service as the custodial scheme but allows landlords to hold onto the deposit during the tenancy.
